WHEREUPON, the following proceedings were had, to wit:

 

MR. ALBERT: Good morning. It is 10:40 a.m. on Wednesday, June 30, 1999. My name is Val Albert. Myself and my co-plaintiff, Pro Se, Galen Cook, have waited for 40 minutes for witness, Mr. Allan Darr. Neither Mr. Darr nor his counsel, Russ Reid, have appeared at his deposition at 818 Yakima in Tacoma, Washington. The deposition was scheduled for 10 a.m. We have not received a phone call from Mr. Darr's attorney, Russell Reid, this morning.

 

We had scheduled two prior depositions with Mr. Darr and have agreed to reschedule them both times. It is apparent that Mr. Darr does not wish to be deposed by Val Albert and Galen Cook.

 

Mr. Albert has driven over 100 miles round-trip to take Mr. Darr's deposition. Mr. Cook has driven over 30 miles.
