Dear Mr. Falkenberg:

My name is Tom Pancini. I am a candidate for Business Manager of Laborer's International Union of North America Local 81 in Valparaiso, Indiana. I am writing to you for answers to some questions that many of my brothers and I have relating to Local 81 policies. Your confidentiality in this matter will be greatly appreciated.

Question number one. Is the hiring list available to people on that list as the rules state? Members have told me that they went to the hall to get a copy of the list, but were told, "We don't make copies available." Is this correct? If not what is the next course of action for someone who wants a copy?

Question number two. Are financial records available to members? I have had some questions about seemingly exorbitant costs of some of our functions. I have asked to see a detailed accounting of these functions, but have been stonewalled thus far. Dale Keene's (secretary Treasurer) last excuse was that Bobbie West of the Department of Labor has told him he didn't have to show me the expenses because I was going to use them for campaign purposes. I talked to Ms. West myself, and she said that Dale Keene is lying. She said she told them I have a right to see the expenses. I have asked verbally and written three letters to Local 81 concerning my request, but have been rebuffed and stonewalled thus far. What do I have to do to receive my constitutional rights? Are the records available to the Local's members?

Question number three. According to what I have read, once I have declared my candidacy, I have the right to the labels for membership mailing list. How much time do I need to give them in order to go to the hall and get labels for mailouts? According to my reading of the rules, they cannot refuse me. Isn't that the way you read it? From previous experience, I think these are valid questions.

Frank Bova has set out in this campaign to delay and stonewall my legal rights according to the constitution as a member in good standing of Local 81. I do not believe that Bova should be permitted to pursue these unlawful tactics. I look forward to your answers to my questions ,within the week.
